U.S. Captures Benghazi Suspect | The Weekly Standard
The United States has captured a second militant in connection with the 2012 attacks in Benghazi, Libya that left four Americans dead, the White House said Monday. "Yesterday, on my orders, United States forces captured Mustafa al-Imam in Libya," President Donald Trump said in a statement. "Because of this successful operation, al-Imam will face justice in the United States for his alleged role in the September 11, 2012 attacks in Benghazi." The first suspect to be publicly charged in relation to the attacks, Ahmed Abu Khatallah, is currently on trial in civilian court in Washington, D.C. Federal prosecutors say that Khatallah planned and oversaw http://www.timbers.co/eyewear/aviator-wooden-sunglasses the attack, inciting others and ensuring that no one interfered. The defense has countered that Khatallah is a convenient "soft target" that the government is pinning blame on. Khatallah is facing 18 counts, including murder, and has pleaded not guilty on all charges. The 2012 attack resulted in the deaths of Ambassador Christopher Stevens, former Navy SEALs Glen Doherty and Tyrone Woods, and Sean Smith, a State Department information officer. Khattalah's trial is reviving controversy over the attack, including questions about the extremist groups behind the violence and the extent to which the attack was planned. It's summer, and that means skirts, shorts and bathing suits that show a little more skin and may make you more conscious of your weight. You could exercise and eat less to lose a few pounds, but two new fitness products claim you can lose inches just sitting still or lying down. Lytess Leggings First, caffeine-infused leggings that claim to take 2 inches off your hips and more than an inch from your thighs just by wearing them for 5 hours a day for 21 days. The Lytess leggings cost $50 to start with (their shapewear line is more expensive). There are styles that offer slimming and contouring like a pair of Spanx and others that are just like soft bike shorts without the shapewear element. When I try them on they smell like fruit, not coffee. Wear them for 2 hours and my legs don't feel invigorated or tingly. I am very sensitive to caffeine and I feel no buzz from any infusion of caffeine. I tried them on at 4 in the afternoon and had no trouble sleeping that night. But is there any science that would support the idea that caffeine rubbed on your skin will help you look thinner or feel skinnier? Exercise physiologist, Samantha Heller says no. "I have not seen any studies in the peer review medical literature about these pants. Wearing a ring or a pair of pants or some kind of bracelet really is not going to help you lose weight. It may be a reminder that you want to skip the cookies you're about to eat, but overall it's not going to change your physiology enough for significant and healthy weight loss." Lytess, the maker of the caffeine pants, uses graphics in its promotional videos claiming 46 percent fat loss in areas of the thighs and buttocks, and yet when we contacted the company it said the following: "The clinical tests that Lytess has performed have shown average slimming results of 0.2" and maximum results of 2.1" on hips and 1.2" on thigh within 21 days. These tests have been performed by an independent ISO 9001 laboratory on a panel over 34 individuals who were required not to change their life style which means: no diet, no exercise while wearing their leggings." Lytess does clarify that it doesn't claim anything about weight loss, only size reduction and smoother skin. And that the company has sold 3.5 million pairs of the pants in France to satisfied customers. Slim Capsule Planet Beach, a franchise of spas, is promoting a device called the Slim Capsule that it says will burn an extra 500 calories just by lying down in it for 30 minutes. The Slim Capsule heats your body up to 180 degrees although your head is outside of the unit and stays cool. I try it by first applying a spot-reducing cellulite cream provided to trouble areas like thighs, hips and buttocks. I wear a papery suit that is intended to retain heat around the body. The capsule opens like some sleep pod from "Star Trek" and I get in to begin the treatment. I ask Kevin Nunez, owner of the Planet Beach franchise we visit in Brentwood, Calif., about how this heat differs from a sauna. "A sauna is pulling water weight from the skin and dehydrating the body," he says. "The use of the infrared heat in the slim capsule helps to reset the metabolic rate, increase cardiovascular circulation and help the body burn more calories." But exercise physiologists ABC spoke with say there are no major studies or research showing increased heat or infrared heat as a key to weight loss or fat reduction. In fact, Samantha Heller says it can be dangerous "Exposing yourself to extreme heat for 20 to 25 minutes can really increase your risk for dehydration, it can increase your risk for heat stroke, other adverse reactions to heat where your body is unable to cool itself down," she says. "You have to be very, very careful. It can interact with certain medications, medical conditions, something you have to be very, very careful of before you printed womens leggings decide this is what you want to do." And even though it claims the device will burn 500 calories, the company that makes the slim capsule says: "The focus for the client using the Slimline pod should be wellness, restful rejuvenation and thermal exercise leading to a cleansing feeling and inch loss, not necessarily weight loss!" After my 30 minutes in the Slim Capsule at Planet Beach I am sweaty, thirsty and ready for a shower. After reviewing the science and the experience of both weight loss products, I think I'll just stick with healthy eating and jogging a few times a week. on a striking pair of circa 1890s Kiowa "boots". I have used quotes around the term "boots" here to reflect the fact that while some people might describe this style of footwear as being a "pair of boots", Vanessa Jennings, a highly respected Kiowa woman, uses the term "leggings" to properly describe this type of footwear. This beautiful pair of young girl-sized leggings was once in my personal collection, and today can be found in the collection of Doug and Karen Rahn. This month's article was made possible with their kind permission. The construction details of this pair reflect classic Kiowa preferences from the circa 1890s reservation period, and they would make a good role model if you wanted to reconstruct a pair from that timeframe today. Having said that, I think it's important to note that while the cut and style of these leggings are correct for the 1890s period, some moccasin characteristics continued to evolve over time, and Kiowa leggings of this type were not always made just precisely this way. There are some aspects of construction and decoration that have changed very little over time, but others have varied a great deal and are certainly worthy of note. [ILLUSTRATION OMITTED] By the late 1890s when Kiowa people were mostly sedentary, and raw materials like buckskin and other hides were in scarce supply, the length of legging tops had been shortened from the style in earlier times when tops were much longer. During the 1890s, just as it is today, these leggings were fastened to the wearer's leg with a single thong tied just below the knee. In earlier times when the Southern Plains tribes were more equestrian oriented and spent a good deal more time riding horses, the tops of these leggings were made to be much longer. The legging tops during this period went well above the knee, and were usually fastened to the wearer's leg with dual tie thongs located above and below the knee. Leggings of this earlier style could be drawn upwards around the legs to protect the thighs when riding horses, and then folded back down over the top tie string to drape over the legging for greater comfort when the wearer was walking in camp. This legging construction detail has certainly evolved over time as a result of patterned leggings real world environmental circumstances. In reality, this evolution in style is not appreciably different than the changing fashion in women's skirt lengths over the same time period. Changes in construction details such as this, which evolve over time, provide students of history a good deal of help in determining the age of an artifact under study. [ILLUSTRATION OMITTED] You may have also noticed that there is a striking resemblance between Comanche and Kiowa leggings of this type. This is true today, and was equally true during the 1890s and earlier times when these tribes were allies and lived in close proximity to each other. I am of the opinion that Kiowa women likely adapted this style of footwear for their own use as a direct result of their early relationship with the Comanche. I believe the Comanche in turn evolved this style of footwear from their relationships with the Apache, and that the Apache probably copied this style of "boot" from the Conquistador "hip boots" which they observed on Spanish explorers in the Southwest. While the Kiowa came south into the Oklahoma Indian Territory from the North and experienced little contact with Spanish explorers themselves, the Comanche were exposed to earlier Spanish influence having arrived in Texas and Oklahoma from the Southwest. When the Comanche and Kiowa tribes eventually joined forces on the Southern Plains, I believe that there was a good deal of material culture influence on the dress and decoration preferences for each tribe, and I think that is why this class of footwear is so similar today. While there are indeed similarities in construction details and decoration preferences for this style of women's footwear for these two tribes, there are also unmistakable differences. I will try to share some of these distinguishing differences with you in this article. In overall construction technique Kiowa and Comanche women's leggings are basically made in the same manner. One of the most significant differences can be found in the shape of the moccasin sole. For Kiowa, the toe shape of the sole is found to be gently rounded as is clearly shown in the photo. The proper Comanche sole shape on the other hand is remarkably different in that the moccasin sole comes almost perfectly to a point at the toe! This is true for both Comanche men's and women's moccasin shape and I am convinced this tradition can be traced back to their association with Apache tribes in the Southwest. In terms of the decorative treatment of the legging tops, there is wide variation to be found in the examples of both tribes. For this pair, the top of the legging has been cut to be level, and then hand punched to accommodate rolled and twisted buckskin fringe. It is also common to see the tops of leggings left un-fringed, as well as the fringe being cut out of the existing top material. After the turn of the century it was not uncommon to see cotton cordage sewn to the legging top to simulate hand twisted buckskin fringe. Like the Comanche, before the turn of the end of the 19th century, the Kiowa usually decorated buckskin clothing with paint of some kind. The pair of moccasins presented here was constructed out of smoked brain-tanned buckskin and painted yellow. Commercial chalk, various dyes, and natural mineral pigments were all used on the Southern Plains at various times to achieve coloration for yellow and green decoration. Vanessa Jennings once told me that the Kiowa used the yellow clay nodules found in Palo Duro Canyon outside Amarillo, Texas to achieve this yellow coloration. Our non-Spanish speaking readers might not know this, but Amarillo is the Spanish word for Yellow! In this pair while the bulk of the legging had been painted yellow, the rectangular flap in front has been accented with contrasting green pigments, and the design field decorated with dual rows of small German silver buttons. This approach to decoration in this frontal flap area is common for both the Kiowa and the Comanche. It is also not uncommon to see large silver Conchos in the same design space and sometimes nothing other than the contrasting paint background. While green is the most common color used in this design space, the color red was also used. [ILLUSTRATION OMITTED] Perhaps the most significant differences between the Kiowa and Comanche preferences will be found in their approach to beadwork decoration. The Comanche women's leggings typically have much less beadwork than their Kiowa neighbors. The same philosophy is applied to the decoration of baby cradles. While the Kiowa cradle is typically fully beaded, the traditional Comanche cradle of the same timeframe is almost entirely devoid of beads! In decorating women's leggings, while it is common to see beaded lanes of beadwork around the ankle and outlining the frontal flap area for both tribes, the Comanche women usually do not place design elements on the top of the moccasin upper, and seldom if ever bead the perimeter of the moccasin. The Comanche color palette is also quite limited when compared to their Kiowa neighbors, generally preferring to use only red and various shades of blue beads on a white background. As evidenced by the photos in this article, the Kiowa not only typically place beaded designs on the central part of the moccasin upper and bead the moccasin perimeter, they also use a much more complete spectrum of color in their beadwork embroidery. This pair of moccasins is beautifully beaded with a wide variety of colors and designs in very small seed beads; dark transparent red, pony trader blue, opalescent transparent pink, chalk pink, turquoise blue, navy blue, butterscotch, chalk white and white core rose all in the same project! Most importantly draw your attention to two observations which are very telling about Kiowa preferences. First, notice that each of the three lanes of beadwork, which outline the rectangular frontal flap is composed of a totally different beadwork design. The lane of beadwork around the ankle of the legging is decorated in yet a fourth different pattern. Combined, these four lanes of beadwork are invariably decorated differently on most early Kiowa leggings. During one of my many museum visits, Joe Hays, when he was Curator of the Museum of the Great Plains Museum in Anadarko, brought this observation to my attention, and expressed the thought that this attribute of Kiowa leggings was purposeful, and perhaps associated in some way with the significance of the number four (directions, seasons, etc)! Lastly I will draw your attention to the beaded geometric designs centered on the top of the moccasin uppers. This style of decoration is traditional for early Kiowa leggings, but one also sees beaded medallions in the same design space. These geometric designs seem at first blush to be symmetric, that is precisely the same for each moccasin, but Kiowa artwork can sometimes be deceptive, and might require a closer look! While the shape of the "arrowhead--like" designs are indeed precisely the same shape, a closer inspection reveals that the colors and in some cases the beads used within the interior of the "arrowhead-like" designs on each moccasin are in fact different! While the outline of the basic design element for each moccasin is the same, pony trader blue over dark transparent red and light turquoise blue, the internal decoration has not only been accomplished using different colors, but different sized beads as well! The right moccasin design element has been accomplished using alternating rows of navy blue and bright chalk pink in the larger segment, and navy blue and opalescent pink in the smaller area. The geometric symbol on the left moccasin uses dark transparent green alternating with a lighter chalk pink color in the larger area, and dark transparent green and butterscotch in the smaller area. While to my eye, and perhaps yours, one would expect the beaded designs to be the same on each moccasin of a pair; this pair clearly shows that Kiowa traditions for symmetry are decidedly different. Referring back to my earlier discussion on cradles, it is also quite common to see an asymmetrical approach to beadwork decoration on Kiowa cradles. The two sides of many Kiowa lattice cradles are often found to be beaded in contrasting colors and differing designs. This preference for asymmetry in Kiowa beaded decoration is not only striking in its artistic appeal, but an important discriminator for this important tribe's artwork. I have found that lack of symmetry in the decoration of Native American wearing apparel was relatively common if not the norm during earlier times before extensive contact with non-Indian influence. I think over time, this fashion gradually changed as a result of increasing cultural contact with non-Indian society, as traders and travelers continued to push further westward. One can readily observe "pair asymmetry" in moccasin pairs, and also in the decoration of pairs of men's leggings in the early paintings and collections of artists such as Catlin. The Washington, D.C.-based startup, which makes sunglasses out of bamboo, is responsible for unleashing a new accessories trend -- and providing free eye exams and eyewear to underprivileged people around the world.
Started by Vincent Ko in 2011, the company creates polarized sunglasses (that float!) from eco-friendly bamboo, a way to pay homage to Ko's Chinese-American background. "Growing up in a Chinese household, we would import a lot of things made from bamboo, the most commonly used wood in China," Ko said. "While it's a new and more expensive trend in America, the strong, sturdy, lightweight material has been used in China for centuries." While he knew he'd be openly battling some of the negative 'Made in China' stigmas, Ko knows that, "bamboo is what China does best." Ko, who partnered with fellow Georgetown alum Luke Lagera and Mike Mills, had his "lightbulb moment" after walking past a display of TOMS Shoes, which donates one pair of shoes for every pair purchased. "TOMS had a huge impact on our idea. They created a shoe that started a movement," Ko said. He set out to design a discussion piece for the face, instead. "If we could have a fraction of what TOMS created, we would be happy." Through a connection of Lagera's, Panda partnered with a small non-profit, The TOMA Foundation, which provides eye exams and general health aid to tribal communities in Columbia, Argentina and India. "When we founded Panda, we realized that 'conscious capitalism' was the way to go," Lagera said. Panda, which now provides a majority of TOMA's funds, donates an eye exam and one pair of eye glasses or sunglasses for every pair sold. "Our partnership also allows us to work hand-in-hand with them and allows us to be a part of their missions." For Ko, working with a small foundation was important. "With larger non-profits, donations might be going towards paying someone's salary, but TOMA allows us to see tangible results." With just an idea, the team posted a project to Kickstarter in late 2011 with a $3,000 goal that was far surpassed, reaching nearly $20,000 from about 300 supporters. The funds allowed Ko to start production with a woodworking shop in China and start enlisting fans. "My partners and I were all working day jobs, so we wanted our customers to be brand ambassadors and help spread the word." While Ko had previously worked at a startup and dreamt of being an entrepreneur, he admits he wood aviator sunglasses knew nothing about retail. After testing the brand through online sources, Ko started applying to accessories trade shows. He recalled a moment of desperation that paid off, heavily. "We had applied to be in the ENK accessories show alongside brands like Lucky and J Brand, but we were put on the back burner because we were so new," he said. "Mike [Mills] sent me a joking email saying to tell the show designer that we'd post up in the broom closet if we had to, so I forwarded the email and they came back and said 'We'll find you a booth instead.'" The show led Panda to eventually ink deals with the Anthropologie brand, where Panda sunglasses are currently being sold in test markets for Urban Outfitters. What's the biggest lesson Ko has learned so far? "TOMS founder Blake Mycoskie says, 'The timing is never right' to start a project. Even though everything was going great with my day job, I knew I wanted to focus on Panda, so I did." Were Mom's fashion rules made to be broken? A panel of fashion designers style experts weighs in on what to wear, and what to leave in the past. Mom Says... "When you have a choice between wearing pants or a skirt, carefully weigh your options...and choose the skirt." Lloyd Boston, author of "Before You Put That On": Truer than ever. Why not go for the skirt? In this age of metrosexual men, sometimes the only thing that separates you from the guys is the power to put on a skirt. Stacy London, cohost of "What Not to Wear" and a New York City-based style expert: Amen to that, Mom. It's much easier to find a skirt that's flattering. With pants, you have to consider the rise, the width of the hips, the legs, and how they fall on the tush. Malia Mills, designer of Malia Mills Swimwear: Carefully weigh your options... and then choose what will make you stride into a room like you own it. "Wear socks that match your printed womens leggings pants." Jenna Lyons, head women's designer for J.Crew: This is so outdated. It's better to give a nod to your pants. If you're wearing gray slacks, try argyle socks with a touch of gray in them. Deborah Lloyd, co-president and creative director of Kate Spade New York: When it comes to socks, tights, and leggings, the new rule is there are no rules. Personal style is all about mixing it up and playing with color and texture. Dana Buchman, designer: Who wears socks? It's hosiery or, better yet, nothing at all. "Always wear shoes that are close in color to your pants, especially if you have big feet." London: Wearing shoes that are exactly the same color as your pants is about as exciting as watching paint dry. Buchman: Oh, my goodness. That really dates from 1910. With all that's going on with shoe design, doing that would leave you out of a lot of the excitement of getting dressed. Lyons: That's crazy. There's nothing better than a bright shoe. As long as it doesn't make your foot look like a boat, you're fine. "Ignore size -- go with what fits you and looks good. Don't get fixated on the numbers." Boston: Moms who know this are geniuses. Remember: The tag is not on the outside of the garment, so no one is going to know. If it makes you feel better, cut the tag out. Buchman: Bless this. It should be taught in schools. Lloyd: This is great advice from a good mother. In a world filled with number-obsessed shoppers, we should keep in mind that clothes that fit properly just look better. "Just because it looks good on the hanger doesn't mean it will look good on you." London: Never judge an item of clothing on the hanger. Clothes are presented that way only because hangers make it easier to store them. You must try them on to know whether the clothes fit and look good on you. Laura Bennett, designer, architect, and former "Project Runway" finalist: If a pencil skirt doesn't work with your body type, I don't care how many pencil skirts you see in stores -- just don't go there. Buchman: I would tell everybody to try something on. It's all about the mirror, not the hanger. That's why there are dressing rooms. "Never buy something on sale you wouldn't buy at full price." Lyons: Brilliant! Everyone should live by that. It's ironic: The thrill in finding something cheap is that it feels like a deal that no one else is getting. But there's a reason no one else bought it-that's why it's still sitting there. Buchman: Absolutely. Sometimes moms are so right. If you don't want it, you don't want it-period. It will just take up time and space. Nanette Lepore, designer: Actually, a sale is a perfect time to try out a new trend. Mom Says... "When you don't have time for a shower, pearls and ponytails are the next best thing." Boston: Yes to the ponytail, even make it a chignon. But scratch the pearls and instead spray a little Febreeze on your outfit. Coming across as fresh is important. Bennett: I live in a ponytail. But as for the pearls, they can make you look like a politician's wife if you're not careful. I like putting on a really long strand that makes a statement. Mills: Pearls, a ponytail...and hot pink underwear. Never underestimate the power of a fabulous set of Skivvies. "Buy quality, not quantity." Boston: Good one, Mom! The woman who has one beautiful, quality tailored black suit can wear it a million times and still look better than the woman who has 17 different pastel suits with threads hanging out of the sleeves. Mills: I prefer to see my closet as a well-mixed drink: two parts quality to one part quantity. I have $325 wedges sitting alongside $19 faux-lizard heels. Lyons: Definitely. There's a reason why most of your printed womens leggings favorite things are probably the ones that you splurged on. You can go back to them time and time again, and they'll still look great. "Wearing all black should be reserved for funerals." Boston: If that were the case, then the most stylish women in Manhattan would be one long funeral procession. Head-to-toe black is universally accepted as chic. Bennett: Unless you're wearing a big hat with a net on it, all black isn't going to make you look like you're going to a funeral. It's a flattering uniform that can be worn every day. Lyons: That is so dated. These days, even bridesmaids wear all black. Just remember that when you're wearing all black, you're creating a silhouette, so choose the shapes of your tops and bottoms carefully. "If you can't breathe in it, you probably shouldn't leave in it." London: Women have a tendency to squeeze into things and say, "If I buy this, there will be motivation for me to lose weight." Then, when that doesn't happen, the skirt hangs in the closet as a shameful reminder. Tugging at your clothes is never a good look. Bennett: Good advice. Sometimes going up a size actually makes the fabric drape better. When something is pulling across the butt -- trust me -- that's what everyone notices. Mills: Too tight is never right. Don't leave in it unless you can dance in it! "Always wear a good bra -- it will make any outfit look better." London: Keep the girls up and high! Take care of them and they'll take care of you. Boston: Mom is 100 percent right. And you shouldn't be wearing the same bra in your 40s that you wore in your 20s. There is technology nowadays that can make women look trimmer, slimmer, and shapelier in an instant. Lepore: Believe in that. You don't want your bosom hanging low. Different women have different needs -- but no matter what, if you have a bra you love, you'll feel and look better. "Always wear a slip." Boston: Absolutely not. A little mystery around the silhouette of a leg is not a bad thing. It's not like people don't know you have legs. Buchman: Never wear a slip, unless you're 120 years old. And not even then. It adds bulk, it adds folds, and it looks tacky if it shows. Put that in the bank. Lyons: Who wears a slip in this day and age? But women should take a good look at their undergarments and observe what they are doing to their backsides. "Brown shoes? Wear a brown belt. Black shoes? Wear a black belt." London: It may be kind of an antiquated rule, but it works. When it comes to shoes and belts, if you mix black and brown, it looks like you woke up and your lightbulb wasn't working. Lyons: That is boring, boring, boring. Make your belt mean something to your outfit. It's not there just to hold your pants up. If you're wearing black shoes, put on a polka-dot or striped belt -- something with a little personality. Boston: From a matching standpoint, it will never fail you. But it's better to mix up shades and finishes within the same color family, like cognac-colored heels in a faux-crocodile print with a cappuccino-colored ribbon belt. "If you smile and make eye contact, no one will care -- or even notice -- what you are wearing." Boston: No matter how big your smile and strong your eye contact, if you're wearing a bad blouse and a pair of pants that should have been donated to charity years ago, it's going to show. Lyons: This is the most important rule. It is so much harder to be critical of what someone is wearing when she is lovely, connected, and interesting. Lepore: That's easier said than done. Not everyone has this kind of confidence or personality, so don't dress like a clown. "People can tell a lot about you by the shoes you're wearing." Boston: Oh, yeah. Scuffed shoes, shoes with chewed-up heels, shoes that have never seen a shoe tree: They all say that you don't care as much as you should about life's overall details. London: True. Shoes are a symbolic accessory -- much more so than jewelry or sunglasses. Mills: Actually, people can tell more about you when they see how you treat a waitress. "Always check your backside in the mirror before you head out." Bennett: That's a good one. After all, your rear view is 50 percent of what people see. That's a large percentage! Lyons: Absolutely. I wish more people did that. Women, check your panty lines. Lloyd: Smart. Yes, I completely agree that it is wise to check what's going on back there. Everything that you care about showing or not showing from the front deserves the same amount of attention from the back. "It's better to be overdressed than underdressed." Bennett: No one has ever been asked to leave a party because of being overdressed. Everyone appreciates glamour. Boston: I agree wholeheartedly. When you walk in underdressed, you have no wiggle room to change it. It's always easier to peel down if you are overdressed. Buchman: It's better to look good than not. Dressing up or down is not the issue. When you're not sure how dressy an event is going to be, just wear the outfit you think you look best in. "Don't mix high-end and low-end pieces." Boston: Wrong. A serious $1,500 suit with a bright $5 tank top underneath it can look better than any other outfit in the room. Lyons: I'm not a fan of this principle. Personal style could mean pairing sneakers with a ball gown. If that's what makes you different -- fine. Mills: Ha! The more often you mix it up, the better. It's called style. Conservatives find themselves in the unexpected position of cheering some of California Governor Jerry Brown's recent vetoes. Most yoga tanks significantly, the Democrat-dominated state legislature wanted to effectively keep the Obama-era standards on sexual assault on campus in place within their state. The Obama administration guidelines, which were never subjected to public notice and comment, triggered some far-reaching changes: ... [they] lowered the burden of proof to a "preponderance of the evidence" standard, which meant that accused students could be found responsible for sexual misconduct if administrators were only 51 percent convinced of the charges; it discouraged allowing the accused and accuser to cross-examine each other, reasoning that this could prove traumatizing for survivors of rape; and it stipulated that accusers should have the right to appeal contrary rulings, allowing accused students to be re-tried even after they had been judged innocent. Education Secretary Betsy DeVos announced in September she was withdrawing those rules and beginning the process of establishing new guidelines. While vetoing the bill, Brown wrote: ...thoughtful legal minds have increasingly questioned whether federal and state actions to prevent and redress sexual harassment and assault -- well-intentioned as they are -- have also unintentionally resulted in some colleges' failure to uphold due process for accused students. Depriving any student of higher education opportunities should not be done lightly, or out of fear of losing state or federal funding. Given the strong state of our laws already, I am not prepared to codify additional requirements in reaction to a shifting federal landscape, when we haven't yet ascertained the full impact of what we recently enacted. We have no insight into how many formal investigations result in expulsion, what circumstances lead to expulsion, or whether there is disproportional impact on race or ethnicity. We may need more statutory requirements than what this bill contemplates. We may need fewer. Or still yet, we may need simply to fine tune what we have. It is time to pause and survey the land. Brown also vetoed legislation that would require presidential candidates to release their tax returns for the past five years in order to qualify for the California ballot, legislation obviously designed to pressure President Trump. Brown wrote, "Today we require tax returns, but what would be next? Five years of health records? A certified birth certificate? High school report cards? And will these requirements vary depending on which political party is in power?" (Interesting irony: Brown failed to release copies of his tax returns during campaigns for governor in 2010 and 2014.) Brown also vetoed "a bill that would have required companies with more than 500 employees to report median and mean salary data on male and female exempt employees, which would have been published online by the Secretary of State." Of course, conservatives won't like all of the Democratic governor's recent decisions. Brown signed a slew of other bills, including one to allow Californians to select "gender-neutral" on their driver's licenses, and a ban on K-12 teachers carrying firearms in schools. Perhaps most significantly, he signed a "sanctuary state" bill into law that will "limit communication between California police officers and federal immigration agents about people detained by police or in jail awaiting trial. Exceptions include those who have been convicted of at least one of hundreds of serious crimes within the past 15 years and suspects in serious crimes punishable with prison time for which a judge has found probable cause. It also prohibits California officers from inquiring about a person's immigration status." |
